Business Restructuring

A business restructuring, in particular where collective redundancies are involved, is often a fairly complex undertaking, requiring a focused and time-conscious planning and implementation process. Restructuring costs must be budgeted for, the consultation process with employee representatives, in particular works councils, must be structured, conducted, and finalized, and risks resulting from statutory and collectively agreed employment protection, in particular potential wrongful selection of redundant staff members, must be considered and balanced against operational requirements to keep your strong performers. 

Michael Tepass has managed a number of business restructuring exercises. He is an experienced negotiator and has conducted many consultation processes and negotiations with works councils on social plans. Michael's experience is that the smart use of "transfer companies" (which allow for a voluntary resignation of affected employees into a government co-sponsored third party entity) is an important instrument in any downsizing effort that will both contribute significantly to the successfull reorganization of the business and keep overall reorganization costs in balance.
